Terms and Conditions 1. As used in these Terms and Conditions 1.1 "we", "our", "ourselves" and "us" means SoWhere2
1.2 "you", "your", "yourself" and "passenger" means any person to be carried on our vehicles, with our consent.
2. Your electronic travel voucher together with these Terms and Conditions, constitutes your ticket for all legal, regulatory and contractual purposes. Presentation of the electronic travel voucher, with photographic identification, is essential for securing our service.
3. Subject to availability and receipt of payment, requests will be processed within 2 days and booking confirmed by way of issue of an electronic travel voucher.
4. Payment for a ticket must be made at the time of reservation. Credit cards (VISA/Mastercard) are accepted for online payments. Credit card transactions will be acquired for SoWhere2 via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa or via Setcom, a payment facility available in over 200 countries and territories. Setcom and PayGate use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on this website. Users may go to www.setcom.com or www.paygate.co.za to view their security certificate and security policy. Customer details will be stored by SoWhere2 separately from card details which are entered by the client on Setcom or PayGate’s secure site. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rands (ZAR). SoWhere2 takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of services.
5. Cancellation of orders by the client will attract a 20% administration fee, if the cancellation is done more than 24 hours before the scheduled transfer. If cancellation is done in 12-24 hours prior to scheduled transfer, a 40% handling charge will be charged. If less than 12 hours notice is given, SoWhere2 reserves the right to charge the full amount of scheduled transfers. The provision of goods and services by SoWhere2 is subject to availability. In cases of unavailability, SoWhere2 will refund the client in full within 30 days.
6. Reservations for a trip can only be done on the website and details can be changed up to 24 hours before the scheduled time of departure of the original trip. No changes are acceptable after this deadline. All reservations, or amendments thereof, have to be done on the Internet. 7. Once a reservation is made, only passengers with positive identification issued in the exact name of the booking, will be allowed to travel. Travel is restricted to the number of passengers declared at the time of reservation and paid for in advance. 8. A standard reservation includes travel for one Adult person with luggage as is normally allowed on airlines. Additional passengers need be paid for, and bicycles, fishing equipment, golf clubs, surfboards, etc., are not considered normal items of baggage and will only be carried subject to availability of space, or if declared and charged for at time of reservation. 9. Passengers arriving on delayed flights will be picked up at no extra charge, but need to expect some changes resulting from rescheduling. A maximum waiting period of 5 hours will be applicable. 10. Passengers on cancelled or changed interconnecting flights into Johannesburg must make these changes known to us by email, web or telephone to allow rescheduling. Failure to do so will result in lack of service and could result in forfeiture of payment. 11. Passengers needing any special assistance including those requiring wheelchair assistance must inform us in advance of these needs, at the time of reservation. 12. We do not accept unaccompanied children under the age of 12 (twelve) years of age for travel. Unaccompanied young persons must be 12 (twelve) years or over to be accepted. Children under 12 (twelve) years of age cannot travel without being accompanied by an adult or a minor aged 16 (sixteen) years or older, who will take responsibility for the child. 13. We do not carry firearms and ammunition, this includes sporting firearms and ammunition. This is not limited to antique swords, knives or similar items. No passengers with firearms will be allowed into our vehicles, under any circumstance. 14. We do not carry live animals (such as insects, reptiles or other form of livestock and the like) on our vehicles with the exception of domestic pets and guide dogs accompanying passengers with disabilities. 15. We reserve the right to refuse travel to passengers who are considered a threat to the safety of our staff or the public.
16. This website is governed by the laws of South Africa and SoWhere2 chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature......
17. SoWhere2 may, in its sole discretion, change this agreement or any part thereof at any time without notice.
18. This website is run by SoWhere2 Transport CC (close corporation) based in South Africa trading as SoWhere2 and with registration number CK2006/125306/23 and K.Laldas (Member(s)) of SoWhere2. SoWhere2 takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
19. All prices listed for products sold on this site include value added tax, where applicable and unless otherwise stated. Note: The current VAT rate in South Africa is 14%
20. If any of the abovementioned terms or conditions are held by a court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
